End User License Agreement (EULA)

1. Introduction

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and A2D Motorsports (“A2D Motorsports,” “we,” “our,” or “us”). By accessing or using our website, digital content, or any software, downloads, data, or materials provided by A2D Motorsports (collectively, the “Services”), you agree to be bound by this Agreement.



If you do not agree with any of the terms of this Agreement, you must not access or use our Services.



2. License Grant

A2D Motorsports grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, strictly in accordance with this Agreement.



You may not:

- Copy, modify, or distribute any part of our website, content, or software without prior written consent.

- Reverse engineer, decompile, or disassemble any part of our digital content or systems.

- Use the Services for unlawful purposes or in violation of any applicable law or regulation.



3. Ownership and Intellectual Property

All content, logos, graphics, text, software, images, data, and other materials on the A2D Motorsports website are owned by or licensed to A2D Motorsports and protected by copyright, trademark, and other intellectual property laws. You acknowledge that this Agreement does not transfer to you any ownership rights in the Services or content.



4. Restrictions on Use

You agree not to:

- Sell, lease, sublicense, or otherwise exploit the Services for commercial purposes without written authorization.

- Use any automated systems or bots to scrape or collect data from the website.

- Upload or transmit viruses, malware, or any harmful code.

- Misrepresent your affiliation with A2D Motorsports or act on our behalf without authorization.



5. Updates and Modifications

A2D Motorsports reserves the right to modify, suspend, or discontinue any part of the Services at any time without notice. Updates may be required to continue using the Services, and your continued use constitutes acceptance of those updates.



6. Termination

This license remains in effect until terminated by you or A2D Motorsports. A2D Motorsports may terminate your license immediately if you breach any term of this Agreement. Upon termination, you must cease all use of the Services and destroy any copies of related materials in your possession.



7. Disclaimer of Warranties

The Services are provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. A2D Motorsports does not guarantee that the Services will be error-free, uninterrupted, or secure.



8. Limitation of Liability

To the fullest extent permitted by law, A2D Motorsports and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or interruption of business, arising from your use of the Services.



9. Indemnification

You agree to indemnify and hold harmless A2D Motorsports, its employees, contractors, agents, and affiliates from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of your use of the Services, violation of this Agreement, or infringement of any third-party rights.



10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Alaska, United States, without regard to conflict of law principles. You agree that any dispute arising under this Agreement shall be brought exclusively in the courts located in Anchorage, Alaska.



11. Severability

If any provision of this Agreement is found invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
